Monod Sports Retail LTD – Event Participation Waiver & Release of Liability

PLEASE READ CAREFULLY. THIS DOCUMENT AFFECTS YOUR LEGAL RIGHTS. BY AGREEING BELOW, YOU ACKNOWLEDGE AND ACCEPT THE TERMS SET FORTH HEREIN.

This Waiver & Release of Liability (the “Agreement”) is entered into between the undersigned participant (the “Participant”) and Monod Sports Retail LTD (“Monod Sports”), with respect to participation in any Monod Sports-organized or affiliated event (each, an “Event”), including but not limited to trail runs, hikes, outdoor excursions, fitness gatherings, and other recreational activities (collectively, the “Activities”), whether free or paid, and regardless of location.

1. Assumption of Risk

I understand and acknowledge that participation in the Activities involves inherent risks, including but not limited to: uneven or slippery terrain, falls, weather-related hazards, encounters with wildlife, dehydration, overexertion, remoteness from medical facilities, equipment malfunction or misuse, and other dangers associated with outdoor recreation. I acknowledge that serious personal injury, permanent disability, or death may occur, and I freely and voluntarily assume all such risks, whether foreseeable or unforeseeable, and regardless of whether they arise from my own actions or the actions of others.

2. Release of Liability & Waiver of Claims

In consideration of being allowed to participate in any Event, I, on behalf of myself, my heirs, executors, administrators, assigns, and representatives, hereby fully and forever release, discharge, and hold harmless Monod Sports Retail LTD and its directors, officers, employees, volunteers, contractors, event partners, sponsors, landowners, agents, and affiliates (collectively, the “Released Parties”) from any and all liability for injury, illness, death, property damage, or any other loss that I may suffer in connection with my participation in the Event or the Activities, including those arising from the negligence of the Released Parties.

3. Fitness to Participate & Personal Responsibility

I certify that I am physically and mentally fit to participate in the Event and that I have not been advised otherwise by a qualified health professional. I understand that medical support may not be immediately available, and I accept full responsibility for my personal safety, hydration, nutrition, gear, and preparedness before, during, and after the Event.

4. Equipment Use & Responsibility

If I use equipment provided by Monod Sports or its partners, I accept it as-is and agree to return it in good condition. I will be responsible for the repair or full replacement of any damaged, lost, or unreturned items. If I use my own equipment, I accept all associated risks related to its condition and suitability.

5. Media Release

I hereby grant Monod Sports the unrestricted, royalty-free right to record, use, reproduce, and publish my name, image, voice, and likeness in any photographs, videos, or other media captured during the Event, for promotional, commercial, or educational purposes in any format now known or later developed, without compensation or right of approval.

6. Minors

If the participant is under 18 years of age, this Agreement must be completed by a parent or legal guardian. By signing, the guardian affirms the minor’s participation, accepts all risks on their behalf, and agrees to indemnify and hold harmless the Released Parties from any claims related to the minor’s participation.

7. Indemnification

I agree to defend, indemnify, and hold harmless the Released Parties from any and all claims, damages, losses, or expenses (including legal fees) arising out of or in connection with my participation in any Event, including claims by other participants, third parties, or arising from my own conduct.

8. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Province of Alberta and the applicable laws of Canada. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9. Acknowledgement

By signing below or indicating my agreement electronically, I confirm that:

  • I have read and understood this Agreement in full.
  • I am at least 18 years of age, or I am the parent/legal guardian of the participant.
  • I voluntarily agree to the terms of this Agreement, which shall apply to this and all future Events organized or affiliated with Monod Sports Retail LTD, unless revoked in writing.
